4. Formation of the Contract
A contract is formed when:
- We confirm the selected service and price;
- You accept the service and these terms; and
- We receive the required payment or deposit.
We will provide confirmation in an email, WhatsApp message, invoice or another format that you can save.
5. Customer Eligibility
You must be at least 18 years old to purchase a service.
If you instruct us for another person, including a child or family member, you confirm that you have their authority or the necessary parental responsibility.
6. Your Responsibilities
You agree to:
- Provide complete, accurate and truthful information.
- Check all forms, letters, itineraries and other materials before they are used.
- Tell us immediately if information or travel plans change.
- Supply requested documents within the agreed time.
- Attend appointments and submit the application through the required official process.
- Pay official and third-party charges directly where required.
- Follow the rules of the relevant embassy, consulate, authority or appointment provider.
- Avoid submitting false, altered or misleading information.
We may refuse to prepare or submit information that we reasonably believe is false, misleading or unlawful.
You remain responsible for the accuracy and completeness of your application.
7. Prices and Payment
The total consultancy price will be confirmed before payment.
An initial deposit may start from £50 per applicant. The exact deposit and remaining balance will be stated in your service confirmation.
Unless expressly included in writing, our price does not include:
- Embassy or consular fees.
- Visa application-centre charges.
- Appointment-provider charges.
- Travel insurance.
- Flights, accommodation or transport.
- Courier, translation or certification fees.
- Charges imposed by independent suppliers.
Payment must be made using the method stated in our invoice or written confirmation.
8. Starting Work During the Cancellation Period
Consumers who purchase at a distance will normally have 14 days to cancel, beginning on the day after the contract is entered into.
If you ask us to begin work during that period, we require an express request from you.
If you cancel after work has started but before the service has been completed, we may charge a proportionate amount for the work supplied up to cancellation.
If the complete service is performed during the cancellation period, you will lose the statutory cancellation right only where you expressly requested early performance and acknowledged that the right would be lost following full performance.
Further details are set out in our Refund Policy.
9. Appointment-Booking Assistance
Appointment-booking assistance is provided through the relevant publicly available appointment system.
All appointments remain subject to:
- Availability on the official system.
- The rules and technical operation of the provider.
- Eligibility requirements.
- Changes, cancellations or restrictions imposed by the provider or relevant authority.
We do not have private, priority or internal access to appointment systems and cannot guarantee that a particular country, date, location or time will be available.
An appointment-booking component is treated as completed once an appointment matching the agreed search criteria has been successfully secured and confirmation has been provided to you.
10. Application and Document Assistance
Forms, letters and supporting materials are prepared using information supplied by you. We do not independently verify every fact or document.
You must review and approve all information before it is submitted or used. If you identify an error, you must notify us promptly.
We do not create false reservations, fabricated documents or misleading information.
11. Third-Party Suppliers
We may provide planning assistance or introduce you to independent suppliers, such as accommodation, insurance or travel-service providers.
Unless expressly stated otherwise:
- We do not sell or provide the third-party service as principal.
- You enter into a separate contract directly with the supplier.
- The supplier sets its own prices, terms, cancellation rules and privacy practices.
- Payments for the third-party service are made directly to the supplier.
- We are not responsible for the supplier’s acts, omissions, availability or performance.
Nothing in these terms makes us the organiser of a package holiday or the provider of transportation, accommodation or insurance.
12. No Guarantee of Outcome
Paying for consultancy does not guarantee:
- An available appointment.
- Acceptance of documents.
- A visa being granted.
- A particular visa duration or number of entries.
- Processing within a particular period.
- Recovery of official or third-party charges.
Visa decisions remain entirely with the relevant authority.
13. Timescales
Any timescale we provide is an estimate unless expressly confirmed as a fixed contractual deadline.
Processing times, appointment availability and decisions controlled by authorities or third parties are outside our control.
We will provide the agreed consultancy service within a reasonable time, taking account of your cooperation and external circumstances.
14. Changes Requested by You
Changes to the destination, travel dates, appointment location, applicant details or service scope may require additional work.
We will tell you about any additional charge before performing work outside the agreed service.
15. Cancellation or Termination
You may cancel by contacting us by email or WhatsApp. Refund eligibility will be determined under our Refund Policy and your statutory rights.
We may suspend or terminate the service if:
- Required information or payment is not provided.
- You ask us to provide false or unlawful information.
- Your conduct towards staff is abusive or threatening.
- Continuing the service would breach legal or provider requirements.
If we terminate without fault on your part, we will refund the amount paid for any agreed service that has not been delivered.
16. Our Standard of Service
We will provide our services with reasonable care and skill.
If a service does not meet this standard, you may be entitled to repeat performance, an appropriate price reduction or another remedy available under consumer law.
Nothing in these terms limits your statutory consumer rights.
17. Liability
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.
We are not responsible for loss caused solely by:
- A decision or delay of an embassy, consulate, government authority or appointment provider.
- The absence of appointments on an official system.
- Incorrect, incomplete or late information supplied by you.
- Your failure to attend an appointment or follow official instructions.
- The acts or omissions of an independent third-party supplier.
- Events outside our reasonable control.
This exclusion does not apply where the loss was caused by our breach or negligence.
We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your statutory rights.
Our services are supplied for personal use. We are not responsible for business losses, loss of profit or loss of business opportunity arising from personal travel plans.
18. Events Outside Our Control
We will not be responsible for delay caused by circumstances outside our reasonable control, including system outages, changes to official processes, industrial action, government restrictions, severe weather or failure of communications infrastructure.
We will take reasonable steps to reduce the effect of the delay and inform you where appropriate.
19. Personal Information
We process personal information in accordance with our Privacy Policy.
You authorise us to use the information you provide for the purpose of delivering the agreed service, including entering customer-approved information into relevant official appointment systems where necessary.
20. Complaints
If you are dissatisfied, contact us promptly at info@breakoutholidays.co.uk with:
- Your name and contact details.
- A description of the service purchased.
- The reason for the complaint.
- The outcome you are requesting.
- Relevant supporting evidence.
We will review the complaint and respond within a reasonable time.
21. Changes to These Terms
The terms in force when your contract is formed will apply to that contract. We may update the website version for future customers.
Any change to an existing contract must be agreed in writing unless required by law.
22. Governing Law
These terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory rights and court protections available in the part of the UK where you live.
